General Provisions
Maverde, LLC (MVD), 2265 Walton Ave, Bronx, NY 10453 (hereinafter referred to as the "Company" or “MVD”), enables users to book professional ground transportation services through its website, mobile applications, and integrated third party platforms (collectively, the "Platform"). The Company provides and arranges luxury chauffeur transportation services including airport transfers, hourly
chauffeur, private events, executive transportation, long-distance rides, and group trips within New
York, New Jersey, and Connecticut.
The Company’s service consists of (a) directly providing transportation using its own fleet of Cadillac
vehicles and professional chauffeurs and (b) arranging transportation for users through trusted,
independent transportation service providers ("TSPs") when necessary. When a TSP performs the
ride, the Company arranges the service but does not itself provide the transportation.
These Terms and Conditions ("T&Cs") govern each booking made via the Platform. They also
describe the details of transportation services for which the user has a direct claim against a TSP
when the Company acts as arranger.
User terms that conflict with these T&Cs are rejected. Any deviations must be agreed upon in writing
by MVD.Contractual Relationship and Contract Conclusion
2.1 Contractual Relationship
When transportation is provided by a TSP, MVD does not perform the transportation and is not an
agent of the TSP. MVD enters into agreements with TSPs in its own name, granting the user a direct
claim for transportation against the TSP (a “contract for the benefit of a third party”). On this basis, the
user may request transportation services directly from the TSP.
Between the user and MVD, the agreement pertains solely to arranging and managing the ride.
MVD’s compensation includes both its service fee and, where applicable, the portion remitted to the
TSP.
When the ride is provided directly by MVD, MVD serves as the transportation provider of record for
that service.
2.2 Contract Conclusion
By submitting a completed booking form through the Platform or by phone, the user submits an offer
to enter into a service agreement (the “Ride Request”). The subject matter of this agreement is the
provision of the requested chauffeur service.
Upon receipt of a Ride Request, MVD will send an acknowledgment summarizing the ride details.
This acknowledgment does not constitute confirmation. A binding booking is formed only when MVD
sends a Booking Confirmation via email or text message. Once confirmed, the user is directly entitled
to receive the agreed ride service.
3. User Account and Registration
The user warrants that all information provided to MVD is accurate and current. Automated
registrations are prohibited. Users are responsible for maintaining the confidentiality of login
credentials and all activity under their account.
4. Transportation Terms
4.1 Ride Types and Flexibility
MVD offers the following ride types: airport transfers, hourly chauffeur, private events, executive
transportation, long-distance rides, and group trips. Same-day bookings are accepted, and there is no
minimum or maximum trip length.
If the actual ride involves additional stops, detours, or requests beyond the confirmed booking, the
chauffeur will accommodate when possible. Additional time or distance will result in updated charges
per Section 5.
4.2 Pickup Time and Adjustments
The agreed pickup time is listed in the Booking Confirmation. For airport pickups, if the correct flight
number is provided, MVD will monitor arrival time and adjust pickup accordingly. For non-airport
pickups, standard waiting time policies apply.
4.3 Vehicle Class and Upgrades
All rides are provided using MVD’s fleet of Cadillac vehicles. Specific models are subject to
availability. MVD reserves the right to upgrade vehicles at no additional cost when possible.
4.4 Luggage and Special Items
Each booking includes standard luggage for all passengers. Oversized or excess luggage, strollers,
wheelchairs, or animals must be disclosed during booking. The chauffeur may refuse undisclosed
items. Approved additional items may incur surcharges.
4.5 Child Safety and Minors
Child restraints must be requested during booking by specifying the number and ages of children.
Unaccompanied minors may be refused transport unless authorized in writing by a parent or
guardian.
4.6 Cancellations, Rebookings, and NoShows
Cancellation: Cancellations made more than 2 hours prior to the scheduled pickup time are free of
charge. Cancellations made within 2 hours of pickup will be charged the full fare.
Rebookings: Treated as new bookings; cancellation rules apply to the original booking.
NoShows: A ride is considered a no-show if the client does not appear within 30 minutes of the
scheduled pickup time (or 60 minutes for airport pickups). No-shows are fully chargeable.
4.7 Passenger Conduct
All passengers must comply with traffic laws and wear seat belts. Chauffeur instructions must be
followed. Smoking and vaping are strictly prohibited. Food consumption is discouraged. Alcohol may
only be consumed with chauffeur consent and in compliance with local laws.
5. Pricing and Payment
5.1 Pricing Principles
All pricing is based on time and mileage rather than flat rates. Rates depend on vehicle class, route,
duration, lead time, and requested extras (e.g., additional stops, waiting time, special
accommodations). Taxes, tolls, and parking fees are additional.
5.2 Waiting Time and Overage
Airport pickups: 60 minutes of waiting time are included. Other pickups: 15 minutes of waiting time
are included. Additional waiting time is billed per minute according to the current hourly rate.
Hourly bookings and long-distance rides are billed in 30-minute increments, rounded up. Mileage
and time beyond the confirmed booking will be charged per the current rate card.
5.3 Payment Methods
All rides must be paid in advance through the Platform. Accepted methods include credit card or other
electronic payment options displayed during checkout. By providing payment information, the user
authorizes MVD to charge for all fares, adjustments, or applicable fees.
5.4 Failed Payments and Fees
For failed or disputed transactions, MVD may charge reasonable administrative fees and recover
associated bank or processor costs.
5.5 Invoicing
Invoices are sent electronically via email to the user’s registered address. Payments via credit card
are due immediately.
5.6 Gratuity
Gratuity is not included in the fare and is left to the client’s discretion.
6. Liability
MVD is liable for damages caused by intentional or grossly negligent acts. For simple negligence,
liability is limited to foreseeable damages from material contractual breaches. These limitations do not
apply to injury, death, or liability that cannot be limited under applicable law.
When a TSP performs the ride, MVD is not liable for their performance. The user’s claims for
transportation lie directly with the TSP.
MVD is not liable for delays or service interruptions caused by weather, traffic, road closures, or other
force majeure events.
7. Changes to Services
MVD may update or modify its Platform or service offerings at any time to improve quality or comply
with applicable laws. Temporary suspension of services may occur for maintenance or upgrades.
8. Intellectual Property
All Platform content, including logos, text, images, and software, are owned by MVD or its licensors.
Users are granted a limited, non-transferable license to use the Platform for booking rides.
Unauthorized use is prohibited.
9. Final Provisions
Governing Law: These T&Cs are governed by the laws of the State of New York.
Venue: Exclusive venue for disputes is the state or federal courts of Bronx County, New York.
